Welcome to Guilt-Free. This website (guiltfreestore.com) is operated by Guiltless Indulgence (ABN 75 489 159 691), trading as Guilt-Free (“we”, “us” and “our”). By using this site or purchasing our products, you agree to these Terms and Conditions.
1. Who we sell to
We operate from Victoria, Australia and currently sell only to customers in Australia and New Zealand. By placing an order, you confirm that you are at least 18 years of age or the age of majority where you live, or that you are ordering with the consent of a parent or guardian.
2. Products and Information
Guilt-Free products are foods regulated under the Australia New Zealand Food Standards Code. Content on this website is general information only and is not medical, dietary or health advice. If you have a medical condition or specific dietary requirements, please speak with your health professional before use. We take care to describe our products accurately, including ingredient and certification details, and we correct any errors promptly once identified.
3. Orders and Acceptance
Your order is an offer to purchase. We accept your order when we dispatch it and will confirm dispatch by email. If we are unable to fulfil an order, for example due to a stock shortage or a genuine pricing or description error, we will notify you promptly and refund any amount you have paid in full.
4. Pricing and Currency
All prices displayed to Australian customers are in Australian dollars and include GST. Prices may change from time to time, but changes do not affect orders we have already accepted. For your convenience, prices can be displayed in AUD or NZD, and the final price is calculated at checkout in your selected currency. Your card issuer may apply its own conversion rates or fees, which are outside our control.
5. Shipping, Returns, Risk and Title
Delivery is governed by our Shipping Policy and returns by our Returns and Refunds Policy, both of which form part of these Terms. Risk in the products passes to you on delivery. Title passes when payment is received in full.
6. Your Statutory Rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law, the Consumer Guarantees Act 1993 (NZ), or any other applicable law that cannot lawfully be excluded.
7. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this website. Nothing in this clause limits or excludes any liability we have to you under the Australian Consumer Law or any other law that cannot be excluded.
8. Intellectual Property
All content on this site, including the Guilt-Free name, logo, copy, graphics and photography, is owned by or licensed to Guiltless Indulgence and may not be reproduced without our written permission.
9. Changes to these Terms
We may update these Terms from time to time. The version published on this page when you place an order is the version that applies to that order.
10. Severability
If any part of these Terms is found to be invalid or unenforceable, the remainder continues in full force and effect.
11. Governing Law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria. This does not affect any mandatory consumer protections that apply in your country or state of residence.
